By clicking the �I AGREE� button, you acknowledge that
you understand and accept the terms and conditions set forth below. If you do
not wish to be bound by these terms and conditions, please click the �I DO NOT
AGREE� button. Equitable PCI Bank may amend this Agreement at any time, and such
modifications shall be effective immediately upon posting of the modified
Agreement. You agree to review the terms and conditions periodically and your
continued use of the Internet Banking Facility will constitute acceptance of this Agreement.
Terms and Conditions of FASTNet
In this agreement, the
words �you� and �your� refer to any individual account holder and �and/or� joint
account holder of the Bank with or without an ATM card and ATM Personal
Identification Number (�PIN�).The words �we�, �our� and �us� refer to Equitable
PCI Bank.
Acceptance
By using FASTNet and the accounts enrolled under the
Internet Banking Facility you agree to be bound by the terms and conditions on
the use of the Internet Banking Facility, including without limitation to the
following paragraphs and to pay any fees identified with the use of
FASTNet.
FASTNet Access
For each approved application to enroll
an account in FASTNet, you shall define a Primary Account
Number (�PAN�) which will serve as your USER ID, a PIN and a Secondary PIN
(�S-PIN�) to access designated transactions in FASTNet.Online enrollment requires the one-time
use of your ATM cardnumber as well as your ATM PIN for registration.You understand that only those accounts
that you specifically enroll will be provided with Internet Banking Services.
We shall not be liable to you if you are not able to gain access to FASTNet. You realize that at certain times,
some or all of the Internet Banking services may not be available due to
maintenance and/or computer, telecommunication, electrical or network failure or
any other reasons beyond our control.
You assume full responsibility for the security of your PIN/S-PIN as well as transactions made
using the said PIN/S-PIN.You understand that for your own safety, we will disable your PIN/S-PIN should the
wrong PIN/S-PIN be used three (3) times. To access your account under FASTNet you may request for a new PIN/S-PIN from
your branch of account.
PIN & S-PIN
The PIN shall be used to access Banking Transactions, which
includes Account Inquiry, Fund Transfer, Bills Payment, as well as other
requests, which includes Checkbook Request and Statement of Account Request. The S-PIN shall be used to perform specific transactions,
such as Fund Transfer Transaction when the Destination Account is not enrolled,
and for Bills Payment Transaction when the company/institution and/or described
subscriber account is not enrolled.
You agree not to disclose your PIN/S-PIN to any person, and assume full responsibility for all
transactions made in your accounts through the use of your PIN/S-PIN. You understand that we will act upon all
instructions and information received from your PIN/S-PIN, and as such, any
Banking Transaction effected using your PIN/S-PIN is presumed to be performed
and authorized by you. We shall be responsible for acting only on those instructions sent to FAST
Net which are actually received and we do not assume any responsibility for disruptions in communications facilities
not under our control which may affect the accuracy or timeliness of the
instructions sent.
You further agree to change your PIN/S-PIN from time to time as you deem necessary, and if
you feel that your PIN/S-PIN has been compromised, you shall immediately change
the PIN/S-PIN through FASTNet�s PIN Change
Facility.
If your PIN/S-PIN has been deactivated/disabled you will have to go to your branch of
account for reactivation.
Reference Number
For every successful transaction a Reference Number shall be assigned to you to serve as
your reference. However, a financial transaction may be denied if the designated
account is insufficiently funded, the PIN/S-PIN/Account Number/Subscriber Number
entered is incorrect, or for reasons of security.
We will not print or issue any confirmation for a successful transaction conducted through
FASTNet. Such transactions will appear under
the Account Inquiry Function of FASTNet,which you may print from your own
computer terminal, as well as in the monthly bank statements issued by your
branch of account.
Transaction Date
Transactions performed after the daily cut-off time in Manila, Philippines, will be reflected
as a transaction of the next banking day and subject to our regular processing
time, which may from time to time be amended. The term �banking day� refers to any day
which commercial banks in Metro Manila, Philippines are open for business, this
excludes Saturdays, Sundays and legal Philippine holidays, including special
non-working holidays declared by the appropriate government
authority.
Offline Transactions
We shall not be held liable for not allowing the client to transact when any of our Deposit
System, Bills Payment System, ATM System, Client Information System is not
online.
Account Inquiry
You can access the current balance, available balance and
transaction history of all your enrolled accounts. The Account Balance can be viewed in the
Philippine Peso equivalent, and US Dollar equivalent. The exchange rate used is
indicative only. Your transactions for the previous month can also be viewed
under Account Statement.
Fund Transfers and Bills Payment
Only cleared and available/withdrawable balances of your enrolled accounts shall be considered for fund transfers and bills payment. In case of insufficient funds in your
account, the transfer or payment request will be automatically rejected and no
further attempt will be made by us to make the transfer or payment. We shall not
be obliged to carry out any transfer or payment instructions because of
insufficient funds from the source account.
We shall not be responsible for any charges imposed or any other action taken by a payee if your
account has insufficient funds, was put on hold or closed, was frozen or
garnished by order of court or other qualified authority, was incomplete and
incorrect in transfer/payment information, and any other circumstances beyond
our reasonable control which prevent the transfer/payment, despite reasonable
precautions taken by us.
It is understood that it is your responsibility to check the status of funds transfers and bills
payment (i.e. �rejected�) transactions. We shall have no obligation or liability
if a transfer or payment is not completed due to insufficiency of funds.
Likewise, it is your responsibility to provide alternative methods for the
transfer/payment. If in case of multiple fund transfers/payments from one source account, and the total available balance of
the account cannot accommodate all of the transfers/payments, we
shall have sole discretion to determine which of the transfers/payments to
complete.
You can only transfer funds to and from accounts of the same
currency.
Immediate fund transfers and bills payment can be done before the cut-off time in Manila,
Philippines. Post-dated transfers and payments can be scheduled and will
automatically be done on the date indicated for transfer/payment. Post-dated
transfers and payments are scheduled at least one (1) banking day before the
date of the transfer/payment. The maximum number of months for post-dated
transfers/payment is twelve (12).
You understand that you may transfer funds to third parties with deposit accounts, however if
the third party account is not enrolled you will have to enter you S-PIN to
proceed with the transaction. Transfers to unenrolled destination accounts have a limit of
Php50,000.
Application for New Account, Checkbook Reorder, Cashier�s/Gift/Traveler�s
Check
You understand that your application for a new account, checkbook, cashier�s/gift/traveler�s check is
subject to the approval of
the branch officer where your account and/or source account was opened. You agree that any cost or service
charge incurred to process your application will be debited from your account
without need for further demand, notice or consent. Checkbooks, cashier�s/gift/traveler�s
checks will be for pick-up at your branch of account once
approved.
ATM Notification
You may notify us of the loss
as well as destruction, mutilation or theft of your ATM card through FASTNet to avoid unauthorized use of the
lost or stolen ATM card. Upon receipt of a report of loss or theft of the ATM
card, no further transaction shall be allowed through the use of the ATM Card.
Transactions effected through the unauthorized use of the ATM card shall
continue to be the your responsibility until such time as the loss or theft has
been properly reported and acknowledged by us. For a new ATM card to be issued,
you will have to submit an Affidavit of Loss to your branch of account along
with your request for re-issuance of a new ATM card.
�And/or� Joint Accounts
It is understood and agreed that any transaction made for �And/or� joint accounts by any one of
you and your co-depositors through FASTNet is understood to be performed with
the consent of all the co-depositors. You shall be jointly and severally liable
for all the liabilities and obligations incurred by the other account
holder(s). You shall report to us
the death of any of your co-depositor, and you shall be held accountable for any
transaction that may prejudice the estate of a deceased
co-depositor.
FASTNet Database Clean-up
In the event you fail to access your FASTNet account within three(3) months after enrollment or
for any three(3) month period, we will automatically unenroll you from the FASTNet database.
Service Charges
You agree that
any cost or service charge incurred will be debited from your account without
need for further demand, notice or consent. We will not be held liable for the
failure of some transactions due to insufficient funds as a result of our
deduction of any charges as authorized by your acceptance of these
terms.
Other Agreements
Transactions performed in FASTNet shall likewise be subject to our
rules and regulations pertaining to savings and current accounts, as well as for
Bills Payment as so far as they are applicable.
Disclosure of Accounts
You agree to waive your right regarding the confidentiality of deposits under RA 1405, as
amended, should the disclosure be necessary and relevant to complete the
transaction desired by us and/or by yourself, and shall render us, its officers
and employees free and harmless from all liabilities due to the said
disclosure.
Notices
Notices, statements and similar matters pertaining to
FASTNet shall be mailed/delivered to your
last know address as appearing on our records or picked up by you from us.
Notice to one shall be considered as notice to the other
co-depositor/obligors.
Termination
You or Equitable PCI Bank may terminate this Agreement any timeupon prior written notice.Liabilities that you incurred shall
however survive the termination.
Indemnification
You shall hold Equitable PCI Bank or its officers
and employees free and harmless from any and all claims, losses, damages,
proceedings or expenses, legal or otherwise, arising from or in connection with
the implementation of this Agreement and the use of the internet banking
facility, FASTNet and shall indemnify us for such
claims, losses, damages or expense. You agree that we shall not be held
liable for any loss or damage resulting from any and all errors unintentionally
committed, any computer software or hardware errors (including computer viruses)
resulting to failure in completion of a transaction, any actions or transactions
